August 2010: Court Grants Preliminary Injunction Against AC Transit

The Alameda County Superior Court granted a preliminary injunction against the Alameda-Contra Costa Transit District (AC Transit), preventing the transit agency from imposing a contract on bus drivers, mechanics, and other workers represented by Amalgamated Transit Union, Local 192 (ATU). The court found that ATU members would be irreparably harmed if AC Transit does not maintain the status quo pending the parties’ interest arbitration and that AC Transit’s imposition of a new union contract likely violated its duty to bargain in good faith. In July, the court had ordered AC Transit, over AC Transit’s opposition, to participate in an interest arbitration with the union to determine the terms of a new collective bargaining agreement.
